1. DEFINITIONS
- App: The Bodapoa mobile application.
- User: Any individual using the app, including drivers and customers.
- Driver: An individual offering ride-sharing or delivery services via the app.
- Customer: An individual requesting a ride or delivery service.
- Delivery Item: Any package or item sent via the delivery service.
2. USER ELIGIBILITY
- Users must be at least 18 years old to register and use the app.
- By registering, you confirm that all information provided is accurate and complete.
3. ACCEPTABLE USE
- Users must not use the app for illegal, harmful, or fraudulent purposes.
- Delivery items must comply with all applicable laws and must not include prohibited items (e.g., weapons, hazardous materials, illegal substances).
4. SERVICE TERMS
a. Ride-Sharing
- Bodapoa connects drivers and customers for transportation services.
- Prices are calculated based on distance, time, and applicable fees.
b. Delivery
- Bodapoa facilitates the delivery of packages as requested by customers.
- Delivery items must be securely packaged by the customer.
5. PAYMENTS
- All payments are made through the app via the available payment options.
- Customers must ensure sufficient funds or valid payment methods for transactions.
- Drivers will receive payment after the service, subject to app commission fees.
6. CANCELLATIONS AND REFUNDS
- Cancellations made before a driver is assigned will not incur a charge.
- Once a driver is assigned, cancellation fees may apply.
- Refunds for disputed transactions will be assessed on a case-by-case basis.
7. USER RESPONSIBILITIES
- Customers must provide accurate pickup and drop-off details.
- Drivers must maintain a valid driver’s license, insurance, and roadworthy vehicles.
- Both parties must conduct themselves respectfully and professionally.
8. LIMITATION OF LIABILITY
- Bodapoa acts as an intermediary and is not liable for any damages, injuries, or losses resulting from the use of the service.
- Users agree that Bodapoa is not responsible for delays, misdeliveries, or disputes between drivers and customers.
9 DATA PRIVACY
- Bodapoa collects and processes personal data in accordance with our https://privacy.bodapoa.com.
- By using the app, you consent to the collection, use, and sharing of your data as outlined in the Privacy Policy.
10. TERMINATION
- Bodapoa reserves the right to suspend or terminate accounts for violations of these terms.
- Users may terminate their accounts at any time through the app.
11. DISPUTES
- Any disputes arising from the use of the service will first be addressed through mediation.
- If mediation fails, disputes will be resolved in accordance with the laws of Kenya .
12. CHANGES TO TERMS
- Bodapoa reserves the right to update these terms at any time. Changes will be communicated via the app.
- Continued use of the app after changes constitutes acceptance of the revised terms.
